Terms of Service

1. Acceptance of Terms

By accessing or using DWMT ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use DWMT. Creators join by invitation. Fans may pay a creator on a public payment link (e.g. dwmt.com/username) without creating a DWMT account; DWMT will verify your phone number before processing the payment.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it current. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Harass, threaten, or abuse other users
• Impersonate any person or entity
• Distribute spam, malware, or other harmful content
• Attempt to gain unauthorized access to the Service or its systems
• Resell, sublicense, or commercially exploit access to the Service without permission

5. Payments: Fan Terms

When you pay a creator on DWMT, your payment goes directly to that creator through Stripe Connect. The creator (not DWMT) is the merchant of record for your transaction. DWMT charges the creator a commission on the amount you pay; we do not take a fee from you beyond what the creator has set as their price.

How the hold works. Your card is authorized when you send a paid message but not charged immediately. If the creator replies within seven days, the hold is captured and the amount is transferred. If the creator does not reply, the hold is released automatically and you pay nothing.

Refunds and disputes. Because the creator is the merchant of record, refund requests go through the creator. DWMT may also issue refunds on the creator's behalf in cases of fraud, regulatory obligations (e.g. EU cooling-off rights), or violations of these Terms. If you have a dispute, contact the creator first; if unresolved, you may contact DWMT support or initiate a chargeback with your card issuer.

6. Payments: Creator Terms

If you accept paid messages on DWMT, you appoint DWMT as your marketing platform and agent for collecting fan payments via Stripe Connect. Each paid message is a direct charge on your connected Stripe account: you are the merchant of record, and DWMT is paid a commission of 20% as an application fee on every such charge.

Fees and costs. Stripe's card-processing fees (currently 2.9% + $0.30 per transaction, subject to change by Stripe) are deducted from the charge before your share settles. Chargeback fees, dispute fees, and refund-related processing fees from Stripe are also your responsibility as the merchant of record.

Chargebacks and disputes. You bear the liability for chargebacks and disputes on paid messages you receive. Stripe will notify you directly at the email address on your Connect account. DWMT does not indemnify you for lost chargebacks.

DWMT's refund authority. You authorize DWMT to issue refunds on your connected account without your individual consent in the following cases: (a) suspected fraud or card testing, (b) compliance with applicable law (e.g. EU cooling-off period), (c) violations of these Terms by you or the paying fan, (d) abuse reports we determine require redress. Refunds we issue on your behalf clawback both your share and our commission proportionally.

Stripe Connect. You must complete Stripe Connect onboarding (KYC, bank details) before receiving paid messages. Stripe's Connected Account Agreement governs your relationship with Stripe. If your Stripe account is closed, suspended, or goes negative, your ability to receive payments on DWMT may be paused until the situation is resolved.

Taxes. You are responsible for reporting the gross income you receive through the Service and for paying any applicable taxes. DWMT will report its commission revenue separately. We may provide information required by applicable tax-reporting laws (e.g. 1099-K in the United States) through Stripe Connect.

7. SMS Notifications

When you use a public payment link, you will receive SMS from DWMT for two purposes: a one-time verification code to confirm your phone number, and a notification text when the creator replies to your message. By submitting the consent checkbox you agree to receive these messages. Message and data rates may apply. You can opt out at any time by replying STOP to any DWMT SMS; further DWMT SMS to that number will cease.

8. User Content

You retain ownership of content you create on DWMT. By posting content, you grant DWMT a non-exclusive, worldwide license to use, display, and distribute that content in connection with operating the Service. You are solely responsible for the content you share.

9. Intellectual Property

The Service, including its design, branding, and underlying technology, is owned by DWMT. You may not copy, modify, or reverse-engineer any part of the Service without prior written consent.

10. Termination

We may suspend or terminate your access at any time, with or without cause. You may delete your account by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Disclaimers

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law, DWMT shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
